D&R Infrastructure update from across Scotland and northern England

D&R is working on infrastructure projects right across Scotland and northern England.

Orkney developments: SSE have multiple projects affecting Orkney including overhead and underground reinforcement works, a new substation, an onshore underground HVAC cable and a 53km subsea HVAC cable connecting to the mainland.

Dumfries & Galloway: Planning approval has recently been granted for KTR – Kendoon to Tongland Reinforcement Project in Dumfries & Galloway. The SPEN project to replace the existing 80-year-old line was met with over 1,000 objections because of the new route through the Galloway Forest Park and the 100’s of larger pylons required, but the Scottish Ministers gave approval because it is classed as essential work in the drive to net zero.

What to do if infrastructure projects may affect your land

The first steps are crucial, but not always clear and time is of the essence. The best opportunity for landowners and tenants to negotiate better terms is at the outset of the project. From previous experience, there are five clear actions that help clients facing infrastructure issues:

Appoint or contact your Land Agent as soon as you know your land will be impacted. It’s worth knowing that reasonable professional advice costs are likely to be covered by the electricity company.

Do not sign anything until you have taken advice – you could miss out on compensation. Our experience and expert industry knowledge enable us to negotiate on our clients’ behalf to ensure they are being fairly represented and fully compensated throughout the project.

Minimise losses – You are responsible for ensuring that all losses, disturbances, and costs incurred are mitigated as far as possible, so it is vital to understand how the works will impact you and your land.

Know your rights – your experienced Land Agent will advise you of your full rights and options and the full extent of what can be claimed.

Record your time – This is an area often overlooked by farmers, but your time is valuable so keep a detailed diary of the time you spend on the project, talking to statutory undertakers, your Land Agent, and in accommodating the work so that this can be considered in any compensation claim.”
